David Tomenes practices in the area of personal injury and wrongful death. David works primarily with railroad employees who have suffered an injury while on duty and individuals who are injured in railroad crossing accidents. David also has experience representing railroad workers who suffer unlawful retaliation by their employers. David has worked on cases throughout the United States, including Minnesota, Montana, and Wisconsin.

David is very involved in his local community. He is the past president of the Washington County Bar Association and currently volunteers as the Committee Chair for his local Cub Scout Pack.

Community Involvement

Representative Case

Voelker v. BNSF Ry. Co. (admitted pro hac vice). A Local Chairman was terminated for providing information related to another employee’s on-duty personal injury claim. The railroad argued that a law protecting the employee’s rights violated the U.S. Constitution. The court found in the Local Chairman’s favor and upheld the law. The case later settled for a confidential amount.
