Inheritance Attorney in Anoka

Four Decades in Anoka County. Estate Planning & Probate Under One Roof.

Inheritance law covers two distinct situations: structuring your estate so assets pass the way you intend, and navigating a loved one’s estate after their death. Bolt Law Firm handles both from our Anoka office, where we’ve served clients throughout Anoka County and the broader North Metro region since the 1980s. Whether you’re planning ahead or stepping into the role of personal representative after a loss, you’ll work with the same team across every stage.

Our estate planning and probate practice operates under one roof. The attorneys who help you build a plan are the same ones who can guide your family through administration when the time comes.

We offer free consultations to prospective clients. Call our Anoka office at (763) 292-2102 to speak with an inheritance lawyer about your situation.

How Minnesota Law Distributes Assets With & Without a Will

A valid will directs how your probate assets are distributed and lets you name a personal representative and designate guardians for minor children. When a will exists, the probate process validates that document and authorizes the personal representative to inventory assets, satisfy debts, and distribute property to beneficiaries.

When someone dies without a valid will, the estate is intestate and Minnesota Statutes Chapter 524 (the Uniform Probate Code) governs who inherits and in what share. The rules follow a fixed priority:

  • Surviving spouse with shared descendants: The spouse inherits the entire estate if all descendants are also the spouse’s descendants and the spouse has no other descendants.
  • Surviving spouse with non-shared descendants: The spouse receives the first $225,000 plus half of the remaining estate.
  • No surviving spouse: The estate passes first to the decedent’s descendants, then to parents, then to siblings and their descendants, then to grandparents and their descendants.

Intestate succession doesn’t account for your actual wishes, and it doesn’t apply to every asset. Property held in joint tenancy with survivorship rights, retirement accounts and life insurance with named beneficiary designations, and assets held in a revocable living trust typically pass outside probate entirely, regardless of whether a will exists.

How Probate Works at Anoka County District Court

Probate for a decedent domiciled in Anoka County at the time of death is handled by the Anoka County District Court, part of Minnesota’s Tenth Judicial District. Minnesota offers both informal and formal probate under Chapter 524. Informal probate involves less court oversight and is primarily paperwork-driven. Formal probate requires a hearing and greater court involvement, typically when disputes arise or the estate is complex.

Both tracks include a mandatory four-month creditor claim period. Informal probate in Anoka County generally takes four to six months depending on estate complexity; formal or contested matters can take 12 months or more. For smaller estates where the decedent’s personal property is valued at $75,000 or less, Minnesota’s Affidavit for Collection of Personal Property procedure may allow heirs to collect assets without formal probate after a 30-day waiting period.

We file probate in Anoka County District Court and work with personal representatives across the region, including Hennepin, Ramsey, Sherburne, Isanti, Wright, and Washington counties. Our step-by-step approach helps personal representatives understand what’s required at each stage and move the process forward.

Planning Ahead: Wills, Trusts, & Beneficiary Structures

Proactive planning lets you control how your assets pass rather than leaving distribution to the intestate succession statutes. A coordinated inheritance plan reviews your will, trust documents, beneficiary designations, and property titling together to close gaps and avoid conflicts between documents.

The tools most often involved:

  • Last Will and Testament: Directs distribution of probate assets, names a personal representative, and lets you designate guardians for minor children.
  • Revocable Living Trust: Holds assets outside of probate so they can pass directly to named beneficiaries without court involvement, which can reduce delays and costs for your heirs.
  • Beneficiary Designations: Retirement accounts, life insurance, and transfer-on-death accounts pass outside probate and should be reviewed as part of any estate plan.
  • Transfer-on-Death Deed: Passes Minnesota real estate directly to named beneficiaries without probate.

Our attorneys personally design each plan around your specific situation and explain every document in plain language. Clients tell us that working through a trust or will with our team felt manageable because we took the time to walk through each choice rather than hand over paperwork and move on. We treat the relationship as ongoing, advising at each stage from initial planning through eventual estate settlement.
